§ 1 Application of General Terms

These General Terms exclusively govern the relationship between - exquisite jazz & world music (hereinafter referred to as and customer (hereinafter referred to as „Customer“). § 4 Costs

§ 5 Due dates, way of payment and payment terms, delay

§ 7 Withdrawal Right

2. In the event of effective withdrawal the mutually received performances shall be returned and recovery of profits (e.g. interest) derived (if any) from such possession shall be made.

3. In the event Customer cannot deliver the Product to or can only deliver the Product in impaired status, Customer is required to provide compensation for the value of the Product. The aforementioned shall not apply in the event the impairment of the Product derives from the inspection of the Product as such inspection could have taken place in the event of the sale of the product in a regular store. In addition, Customer shall be able to avoid such requirement of providing compensation by avoiding the use of the Product as an owner and/or refrains from doing anything which might decrease the value of the Product.

4. Ready to send goods shall be resent. In the event of resending Product with a total purchase value of up to € 40,-, the Customer has to bear the re-delivery costs, provided the Product equals the order made. In any other event, shall bear the re-delivery costs, provided always that the re-delivery shall be made sufficiently stamped and the cheapest form of delivery shall be chosen. Product not suitable for package delivery will be picked up at Customer.

Notwithstanding § 195 BGB, „Jazz And Records" claims shall become statute-barred after five (5) years. The period of limitation begins to run according to § 199 BGB.

§ 12 Personal Data shall keep confidential personal data collected from Customer. The Customer hereby agrees that may use the information and personal data provided by Customer for purposes of processing and storing and using such information and personal data in connection with processing of the orders, the delivery of Product and verification of the payments, as well as the communication with the Customer in respect of the deliveries, the Product and marketing offers. The collected data will be provided by to third parties, only in the event such third parties provide services to in connection with the aforementioned services.

§ 13 Applicable Law
